Citizenship of Turkmenistan is one of the important subjects of state sovereignty of Turkmenistan and determines the person's belonging to the state and the integrity of the stable legal relationship, mutual rights and obligations between the state and the person;
Persons who obtained citizenship according to the Law of Turkmenistan "On Turkmenistan Citizenship" are considered citizens of Turkmenistan;
The passport of a citizen of Turkmenistan is considered a document confirming citizenship of Turkmenistan;
Citizenship of children under 16 years of age is confirmed by their birth certificate or the passport of one of their parents who is a citizen of Turkmenistan;
Residence of Turkmenistan citizenship in the territory of another state does not mean cancellation of Turkmenistan citizenship;
The basis for obtaining Turkmenistan citizenship:
1. From the moment of birth of a person;
2. As a result of acceptance to Turkmenistan citizenship;;
3. With other bases stipulated by the Law "On Turkmenistan Citizenship" of Turkmenistan;
Citizenship of children whose parents are citizens of Turkmenistan:
If one of the parents of the child had Turkmenistan citizenship until the child was born, that child is considered a Turkmenistan citizen in the following cases;
1. If the child was born on the territory of Turkmenistan;
2. If the child was born outside the territory of Turkmenistan, but his parents or one of them had permanent residence in the territory of Turkmenistan at that time;
If parents have different citizenships and one of them was a citizen of Turkmenistan until the birth of the child, and at that time both parents of the child have a place of permanent residence outside the territory of Turkmenistan, then the citizenship of the child is determined by the written agreement of the parents;
If, until the birth of the child, one of the parents is a citizen of Turkmenistan and the other one doesn’t have citizenship, or if the parents are unknown, then such a child is considered a citizen of Turkmenistan, regardless of the place of birth;
If, at the time of determining the paternity (father) of the child, his/her mother doesn’t have citizenship and a citizen of Turkmenistan is recognized as his/her father, the child under the age of 14 remains a citizen of Turkmenistan, regardless of where he/she was born. If the child lives permanently outside the territory of Turkmenistan, his/her citizenship is determined by the written application of his parents;
Child of people without citizenship acquire Turkmenistan citizenship;
The child born within the territory of Turkmenistan of a person who does not have citizenship but has permanent residence in Turkmenistan is considered a citizen of Turkmenistan;
Citizenship of children whose parents are unknown:
A child whose parents are unknown and living in the territory of Turkmenistan is born in Turkmenistan and is considered a citizen of Turkmenistan. This child's citizenship can be changed in accordance with the Law if one of his parents, guardians or guardians is present;
Conditions for accepting Turkmenistan citizenship;
A person may be granted citizenship of Turkmenistan upon his/her request in the following cases;
If he/she:
1. If it considers it an obligation to comply with and respect the Constitution and laws of Turkmenistan;
2. Knows the state language of Turkmenistan within the scope of speech;
3. If there is a permanent residence in the territory of Turkmenistan in the last 7 years;
4. If there is a legal source of income on the territory of Turkmenistan;
Turkmenistan citizenship is canceled in the following cases:
1. Due to relinquishment of Turkmenistan citizenship;
2. Due to loss of Turkmenistan citizenship;
3. According to other basises stipulated by the Law "On Turkmenistan Citizenship" of Turkmenistan;
Termination of Turkmenistan citizenship:
Termination of Turkmenistan citizenship is carried out upon the request of the person in accordance with the procedure prescribed by the Law of Turkmenistan "On Citizenship of Turkmenistan";
Turkmenistan citizenship is lost in the following cases:
1. This does not include cases where a person is assigned to military service, security service, police, justice institutions or other state authorities and administrative bodies in another country, but provided for in intergovernmental agreements of Turkmenistan;
2. If Turkmenistan citizenship was obtained as a result of blatantly submitting false information or false documents;
3. According to the principles stipulated in Turkmenistan's intergovernmental agreements;
President of Turkmenistan:
The President of Turkmenistan makes decisions on issues related to Turkmenistan citizenship. The President of Turkmenistan adopts the following decisions on citizenship issues;
1. On the admission to Turkmenistan citizenship of citizens of other states and persons who haven’t got citizenship living in and outside the territory of Turkmenistan;
2. On the reissue of citizenship of Turkmenistan;;
3. About the removal of Turkmenistan citizenship;
4. Regarding the non-satisfaction of requests regarding admission and reissue;
5. On the loss of citizenship of Turkmenistan based on clauses 2 and 3 of Article 23 of the Law "On Citizenship of Turkmenistan".
